In a landmark and unprecedented ruling issued Tuesday, the U.S. Supreme Court has declared that any military operation against Greenland conducted without explicit authorization from Congress would constitute a criminal act under U.S. law. The decision sharply reinforces constitutional limits on executive war powers and sends a direct warning to senior military leaders and rank-and-file service members alike.

According to the Court’s majority opinion, the Constitution grants Congress—not the president—the sole authority to authorize acts of war, particularly against foreign territories with which the United States is not in active conflict. The ruling states that obedience to presidential orders does not provide legal immunity when those orders are deemed unlawful.

In unusually direct language, the Court warned that generals, officers, and soldiers who participate in such an operation could face criminal prosecution, even if acting under orders from then-President Donald Trump. “The duty to the Constitution supersedes the duty to any individual officeholder,” the opinion reads.

Legal analysts say the ruling dramatically clarifies the limits of the “just following orders” defense and could have lasting implications for civil-military relations. Pentagon officials have not commented publicly, though sources indicate the decision has prompted urgent internal legal reviews.

The ruling is expected to fuel intense political debate, particularly over executive power, military obedience, and the rule of law in times of political volatility.
