In a landmark and unprecedented ruling issued Tuesday, the U.S. Supreme Court has declared that any military operation against Greenland conducted without explicit authorization from Congress would constitute a criminal act under U.S. law. According to the Court’s majority opinion, the Constitution grants Congress—not the president—the sole authority to authorize acts of war, particularly against foreign territories with which the United States is not in active conflict. In unusually direct language, the Court warned that generals, officers, and soldiers who participate in such an operation could face criminal prosecution, even if acting under orders from then-President Donald Trump. “The duty to the Constitution supersedes the duty to any individual officeholder,” the opinion reads.
