Supreme Court Denies Trump’s Emergency Bail Request — Sentencing Set to Proceed

In a sharply divided ruling, the U.S. Supreme Court has **rejected an emergency bid by former President and current president-elect Donald J. Trump to stay or delay his upcoming sentencing in a New York criminal case — a move that ends his last-minute effort to pause legal consequences as his administration prepares to begin a new term.

Trump had asked the nation’s highest court to intervene after lower courts refused to halt the scheduled sentencing tied to his conviction in Manhattan on 34 felony counts of falsifying business records related to a 2016 “hush money” payment. The Supreme Court’s brief emergency order denied that request in a 5–4 vote, with Chief Justice John Roberts and Justice Amy Coney Barrett joining the court’s three liberal justices in the majority.

Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh signaled they would have granted Trump’s request.

The Court’s decision clears the way for the sentencing to go forward as scheduled, allowing the state court to formally impose judgment. New York Judge Juan Merchan has indicated he will likely impose an “unconditional discharge,” which means Trump will be convicted and have a felony on his record, but will face no jail time, fines or probation under current plans.

Trump’s legal team argued that forcing the president-elect to face sentencing could disrupt the transition and infringe on constitutional questions about presidential immunity. Prosecutors countered that any such concerns can be handled on direct appeal and noted there is no established immunity for a president-elect at the state level.

The Supreme Court’s rejection of Trump’s emergency plea marks the latest in a string of high-stakes legal confrontations surrounding the former president. It comes amid several ongoing criminal and civil cases, even as Trump maintains a prominent role in national politics.
